{"id":9,"date":"2006-12-03T18:21:00","date_gmt":"2006-12-04T03:21:00","guid":{"rendered":"http:\/\/localhost\/wordpress\/?p=9"},"modified":"2007-01-23T13:14:18","modified_gmt":"2007-01-23T22:14:18","slug":"ken-starr-to-fight-free-speech-in-ak","status":"publish","type":"post","link":"https:\/\/www.evardsson.com\/blog\/2006\/12\/03\/ken-starr-to-fight-free-speech-in-ak\/","title":{"rendered":"Ken Starr to fight Free Speech in AK"},"content":{"rendered":"<p>Rather than try to explain the entire case, which the <a href=\"http:\/\/www.cnn.com\/2006\/LAW\/12\/01\/scotus.bonghits\/index.html\">article at CNN<\/a>  does so well already, I&#8217;ll summarize:<\/p>\n<p>In 2002, Joseph Frederick, a Juneau, AK senior was suspended for displaying a banner reading &#8220;Bong Hits 4 Jesus&#8221; on a public sidewalk outside the school. School officials suspended him because, in their argument, it was a school function, since the students had been let out of class to watch the Olympic torch go by, and were accompanied by teachers.<\/p>\n<p>Frederick&#8217;s family brought a suit against the school board for violation of his First Amendment rights and the 9th US Circuit Court agreed.<\/p>\n<p>Now the school board, represented (pro bono) by Ken Starr is preparing to appeal.<\/p>\n<p>My take on it is this: the school does <em>not<\/em> have the right to impinge on the free speech of students when they are off-campus, not in class, and it does not have an effect on the educational mission of the school.
